Terms of Service

1. The service

Presto Bee is a listing management workspace for online resellers. It helps you create listings, cross-list them to marketplaces you connect (currently Poshmark, Mercari, and Depop, with more marketplaces added over time), share listings, send offers, and track listing and order status.

Presto Bee is an independent tool. It is not affiliated with, endorsed by, or sponsored by any marketplace. Marketplaces may change or restrict their platforms at any time, which can affect or interrupt Presto Bee features that depend on them.

2. Your account

You need an account to use Presto Bee. You are responsible for the accuracy of your account information, for keeping your password confidential, and for all activity under your account.

You must be at least 18 years old, or the age of majority where you live, to use Presto Bee.

3. Marketplace connections

When you connect a marketplace account, you appoint Presto Bee as your limited agent, solely to perform the actions the product performs on that account at your direction — creating, updating, and delisting listings, sharing, sending offers, completing verification steps (including captcha challenges) needed to perform those actions, and reading listing and order data. This is a limited authorization for those tasks only; it creates no broader agency or fiduciary relationship. You confirm the connected accounts are yours.

How connections run. You can connect through the Presto Bee browser extension, which acts within your own browser session, or by providing your marketplace username and password, which Presto Bee uses to sign in and establish a session on your behalf. Your password is used to sign in and is not stored by Presto Bee; we retain your marketplace username and an encrypted session token (see the Privacy Policy). Bulk actions and AI drafts include a review checkpoint before publishing.

Marketplace rules and account risk. Each marketplace sets its own terms, and some marketplaces restrict or prohibit automated or third-party access to accounts. Using a tool like Presto Bee to act on your account may be inconsistent with a marketplace’s terms, and a marketplace may, at its discretion, limit, restrict, or suspend an account. You understand and accept this risk. Presto Bee acts at your direction; you remain responsible for the content and legality of your listings and for your use of every connected marketplace, and Presto Bee does not control and is not responsible for a marketplace’s enforcement decisions.

4. Plans, trials, and billing

Paid plans are billed monthly or annually, in USD, at the prices shown on the pricing page. New accounts start with a 14-day free trial. A payment method is required to start the trial; you will not be charged during the trial itself.

If you do not cancel before the trial ends, your card is charged automatically — $19.99/month, or $215.88/year if you chose annual billing — and your subscription renews automatically at that same rate every billing period after, until you cancel. We email you 3 days before your first charge, stating the exact date and amount.

You can cancel anytime before the trial ends and you will not be charged. You can also cancel anytime after; cancellation stops future renewals and your plan remains active until the end of the period you already paid for. Cancel from Settings.

Some AI features are metered: each plan includes a monthly allowance, and use beyond the allowance bills at the per-generation rate shown on the pricing page. Prices may change with notice; changes apply from your next billing period.

5. Acceptable use

Do not use Presto Bee to list items that are illegal, counterfeit, or prohibited by the target marketplace; to infringe intellectual property rights; to interfere with or abuse the service; or to access accounts that are not yours.

We may suspend or terminate accounts that violate these terms or that create risk for other users, marketplaces, or Presto Bee.

6. Your content

You keep ownership of the photos, listing text, and inventory data you bring to Presto Bee. You grant us the limited license needed to operate the service: storing, processing, and transmitting your content to the marketplaces you direct it to.

AI-generated titles and descriptions are drafts for your review. You are responsible for what you publish.

7. Disclaimers

Presto Bee is provided "as is" and "as available." We do not guarantee uninterrupted service, that any listing will publish successfully on a marketplace, or that a marketplace will not restrict or suspend a connected account. To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these terms limits liability that cannot be limited under applicable law, including liability for our own negligence, willful misconduct, or violation of law.

8. Limitation of liability

To the fullest extent permitted by law, Presto Bee’s total liability for any claim arising out of or relating to the service is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, sales, or data.

9. Your indemnity

You agree to indemnify and hold Presto Bee harmless from third-party claims (including claims by a marketplace) arising out of actions you direct Presto Bee to take on a connected account, the content you publish, or your breach of these terms — except to the extent the claim arises from Presto Bee’s own negligence, willful misconduct, or violation of law.

10. Termination

You can stop using Presto Bee and cancel your subscription at any time from Settings. We may suspend or terminate the service for breach of these terms. On termination, your right to use the service ends; sections that by their nature should survive (including 6 through 9 and 12) survive.

11. Changes to these terms

We may update these terms as the product evolves. If a change is material, we will notify you (for example by email or an in-app notice) before it takes effect. Continuing to use Presto Bee after a change takes effect means you accept the updated terms.

12. Governing law and disputes

These terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law rules. Nothing in this choice of law waives any consumer-protection right you have under the laws of the state where you live that cannot be waived by agreement.

Any dispute arising out of or relating to these terms or your use of Presto Bee will be resolved by binding arbitration on an individual basis, administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. Either party may instead bring an individual claim in small-claims court if it qualifies, and either party may seek injunctive relief in court to protect intellectual property or account security.

You and Presto Bee waive any right to bring or participate in a class, collective, or representative action, and the arbitrator may not consolidate more than one person’s claims or preside over any representative proceeding. This section does not waive any right to public injunctive relief that cannot be waived under applicable law.

If the class-action waiver in this section is found unenforceable as to a particular claim, that claim (and only that claim) will proceed in court rather than arbitration; the rest of this section remains in effect. If any other part of this section is found unenforceable, the remainder stays in effect.
